Orbee Terms of Service

• Minimum Age: You must be at least 18 years old to use our Services.
• Account Responsibility: You are responsible for all activity that occurs under your account. You may not share your login credentials with anyone else. Please notify us immediately at legal@orbee.cc if you suspect unauthorized access to your account.

You may use our Services only in compliance with these Terms and our Usage Policy. You may not:

• Use the Services for any illegal or unauthorized purpose.
• Attempt to reverse engineer, decompile, or otherwise discover the source code of our Services.
• Develop a competing product or service, including using our Outputs to train a competing AI model.
• Use automated means (like scraping or crawling) to access the Services without our permission.
• Resell or sublicense our Services without our express written permission.

• Inputs and Outputs: You may provide text descriptions ("Inputs") to our Services, which generate images or videos ("Outputs"). Together, these are your "Content."
• Your Ownership: As between you and Orbee, you retain all rights to your Inputs. Subject to your compliance with these Terms, Orbee assigns to you all of its right, title, and interest in and to the Outputs you create. **This means you own the images and videos you generate on a paid plan.**
• Responsibility: You are responsible for your Content and must ensure you have all necessary rights to provide the Inputs to our Services.
• Our Use of Content: We may use your Content to provide, maintain, and improve our Services, and for safety and security purposes, unless you opt out in your account settings.
• Disclaimer on Outputs: AI is an emerging technology. Outputs may not always be accurate and may sometimes be unexpected. You should not rely on Outputs without independently verifying them.

• Subscriptions: To access premium features, you must purchase a subscription ("Subscription").
• Credits: Your Subscription provides you with "Credits" each month. Different actions consume different amounts of Credits. Unused Credits do not roll over to the next month unless specified otherwise.
• Billing: You agree to provide accurate payment information. We will automatically charge your payment method at the beginning of each billing cycle.
• Cancellation: You may cancel your Subscription at any time through your account settings. Your access will continue until the end of the current billing period, and you will not be charged again. Payments are non-refundable except where required by law.
• Fee Changes: We may change our subscription fees from time to time. We will provide you with at least 30 days' notice before any price increase.

THE SERVICES ARE PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, Orbee AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT WILL Orbee BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE SIX MONTHS PRIOR TO THE CLAIM, OR $100.

You may stop using our Services at any time. We reserve the right to suspend or terminate your access to the Services at any time, without notice, if we believe you have violated these Terms or our Usage Policy.

• Governing Law: These Terms will be governed by the laws of Uganda.
• Changes to Terms: We may revise these Terms from time to time. If we make a material change, we will provide you with notice. Your continued use of the Services after the changes become effective constitutes your agreement to the new Terms.
• Entire Agreement: These Terms, along with our Privacy Policy and Usage Policy, constitute the entire agreement between you and Orbee.
